Hiring a Foreign Employee in Azerbaijan: Employer Requirements (2026)

Azerbaijan welcomes foreign specialists, and the rules for hiring them are clearly set out in the Migration Code and the Labour Code. For the employer, the key is the right order: permit first, contract second.

Short answer: To hire a foreign national legally in Azerbaijan, the employer first obtains a work permit for them from the State Migration Service (unless the employee falls into an exempt category), then signs an employment contract for the permit’s validity term and registers the contract notification in the electronic system. After that, the employer tracks extension deadlines and reports any early termination.

What must the employer do before hiring?

The first step is to check whether the employee needs a work permit at all. It is not required, for example, for permanent residence permit holders, heads of foreign company branches, a founder holding at least a 51% share and several other categories listed in the Migration Code.

If a permit is needed, the employer obtains it — a legal entity, an individual entrepreneur without a legal entity, or a branch or representative office of a foreign company. An employment contract with a foreign national cannot be signed before the permit is issued. The review takes into account whether there is a vacancy and whether the employment service can meet the need from the local labour force, so the application includes a justification for the hire. The employer also submits its corporate documents, proof of the employee’s qualifications and a medical certificate in the prescribed form. Since 1 November 2024, the permit is issued electronically.

What obligations apply once the permit is issued?

Working without a properly formalised employment contract triggers financial sanctions under the Tax Code, so the sequence “permit — contract — notification” is best followed from day one.

How are the employee’s registration and residence permit handled?

The employee’s migration documents run in parallel with the employment paperwork:

  • Registration at place of stay — within 15 days of arrival in Azerbaijan; the details are submitted by the host (hotel, property owner) or by the foreign national.
  • Temporary residence permit — an issued work permit is one of the grounds for a temporary residence permit.
  • Timing of both documents — the employee’s residence permit relies on the work permit, so it is wise to plan both extensions together.
  • Change of job — if the contract ends early, the work permit loses its validity; without another ground to stay, the employee must leave within 10 working days.

Can you hire a foreigner without a work permit?

Yes, if the employee belongs to an exempt category. Besides those mentioned above, these include spouses of Azerbaijani citizens (where the citizen spouse is registered at a place of residence in the country), highly skilled migrants working in their field, and technology park residents and the ICT specialists they engage. An exemption from the work permit does not replace the employment contract or the employee’s migration status — these are separate matters.

— SME: Before hiring, check whether the candidate falls into an exempt category: if the foreign national will be a founder with a 51% or larger share, or the head of a branch, the whole process is different. Frequently asked questions

Can I sign an employment contract with a foreign national before the permit is issued?
No. The employment contract is signed only after the work permit is issued and for its validity term.

Who registers a foreign employee at their place of stay?
The host — a hotel or the property owner — or the foreign national themselves, within 15 days of arrival.

Does a foreign director need a work permit?
The head of an Azerbaijani company whose founder is a foreign person, and a founder holding at least a 51% share, do not need a work permit. Residence is dealt with separately.

What should the employer do if a foreign employee resigns?
Notify the Migration Service within 5 working days. The work permit then loses its validity.
