Registering as an Individual Entrepreneur in Azerbaijan as a Foreigner: Do You Need a Residence Permit?

Individual entrepreneur status (fərdi sahibkar) is the simplest way to work for yourself in Azerbaijan. For foreigners there is one key condition worth knowing in advance, so you can plan both the move and the business properly.

Short answer: Yes, a foreigner can register as an individual entrepreneur in Azerbaijan, but this requires a temporary or permanent residence permit: for tax registration, foreigners and stateless persons present a residence permit card issued by the State Migration Service, or a refugee card. The registration itself is quick — immediate online, or within one day on paper.

Does a foreigner need a residence permit to register as an individual entrepreneur?

Yes. An individual entrepreneur in Azerbaijan is a natural person registered with the tax authority to carry out business activity. In its list of documents for registering individuals, the State Tax Service specifies the identity document: an ID card for Azerbaijani citizens, and for foreigners and stateless persons, a temporary or permanent residence permit issued by the State Migration Service, or a refugee card. A foreign passport without a residence permit is not on that list.

You need to register before you start your business activity.

How can a foreigner get a residence permit in order to register?

Residence permits are issued by the State Migration Service on one of the grounds set out in the Migration Code. Owning property or planning a business does not grant a residence permit automatically — these are grounds to apply, and the State Migration Service makes the decision.

Ground for a temporary residence permit (selected) What to know
Employment with a work permit The residence permit is issued on the basis of the work permit obtained
Heading a company in Azerbaijan For the head of a legal entity established in Azerbaijan, with paid-up capital not below the amount approved by the Ministry of Economy; also for the head or deputy head of a foreign legal entity’s branch or representative office
Entrepreneurial activity When applying after one year of residence, a tax authority document on turnover for the last year is required
Family and other grounds Kinship with an Azerbaijani citizen, investment, real estate and other grounds on the State Migration Service list

More on the grounds in our guide How to Get a Residence Permit in Azerbaijan (2026).

How does registration work once you have a residence permit?

With a residence permit in hand, the registration itself takes very little time. You can apply through the tax service’s online portal (İnternet Vergi İdarəsi) using ASAN İmza, another electronic signature or the SİMA mobile signature — in that case registration is immediate. On paper, registration is completed within one day. A representative holding a notarised power of attorney can also file on your behalf.

Before registering, it’s worth deciding a few things in advance:

  • residence permit validity — it should cover the period you plan to work;
  • type of activity — some fields also require a licence or permit;
  • tax regime — it depends on the activity and expected turnover;
  • a bank account for payments with clients.

What are the options if you don’t have a residence permit yet?

If you don’t have a residence permit yet, a convenient alternative is an LLC with foreign investment. A foreign individual or foreign company can be the founder, and the State Tax Service document list asks an individual founder for an identity document, not a residence permit. Electronic registration of such an LLC takes 2 days. Heading a company in Azerbaijan, subject to the capital requirement, can then become a ground for applying for a residence permit.

— SME: Foreigners often start by asking how to register as an individual entrepreneur, when an LLC actually fits their goal better: it can be registered without a residence permit, and the residence question can then be built around the company. We look at the goal first — working for yourself, hiring staff, relocating your family — and only then suggest the business structure and the order of steps.

Frequently asked questions

Can I register as an individual entrepreneur in Azerbaijan with just a passport?
No. For foreigners, the document list specifies a temporary or permanent residence permit issued by the State Migration Service, or a refugee card.

Can I register online?
Yes, through the tax service’s online portal using ASAN İmza, an electronic signature or SİMA. Electronic registration is immediate.

When do I need to register?
Before you start your business activity.

Does individual entrepreneur status give a right to a residence permit?
Not automatically. Entrepreneurial activity is one of the grounds for a residence permit on the State Migration Service list; when applying after one year of residence, a tax authority document on turnover is required. The decision rests with the State Migration Service.
