Moving to Azerbaijan is rarely a solo project: a spouse, children and sometimes parents come along with the main applicant. The Migration Code provides family grounds for residence permits directly — the key is knowing who qualifies and for how long the permit is issued.
Short answer: A family-based residence permit in Azerbaijan is available in two cases: you are a close relative of an Azerbaijani citizen, or a family member of a foreigner living there on a temporary or permanent permit. A foreigner’s family members are the spouse, children under 18, adult children unable to work and dependent parents. The State Migration Service decides.
Who can get a residence permit on family grounds?
The Migration Code sets out two groups, and the circle of relatives differs between them.
| Group | Who is included | Legal ground |
|---|---|---|
| Close relatives of an Azerbaijani citizen | Father, mother, spouse, children, brothers and sisters and their children, grandparents, great-grandparents, grandchildren, parents-in-law and certain other in-laws | Article 45.1.1 of the Migration Code |
| Family members of a foreigner with a temporary or permanent permit | Spouse, children under 18, children over 18 who are unable to work, dependent parents | Article 45.1.5 of the Migration Code |
The difference matters: close relatives of an Azerbaijani citizen are defined broadly, while for a foreigner’s family the law limits the circle to immediate family. For example, an adult son of a permit holder who is able to work does not qualify on family grounds — he needs a ground of his own, such as employment, study, business or investment.
How long is a family permit issued for, and can it lead to permanent residence?
A temporary residence permit on family grounds is issued for up to 1 year and can then be extended each time for up to 2 years. After at least 2 years of continuous temporary residence, you can apply for a permanent residence permit, issued for 5 years, if your father, mother, spouse, child, brother or sister is an Azerbaijani citizen, or if you are a family member of a foreigner who permanently resides in Azerbaijan.
There is one important nuance. If a family member received a permit as the relative of a foreigner who lives in Azerbaijan on a work permit, as a student, for religious activity or under an international agreement (Articles 45.1.8–45.1.11 of the Migration Code), that residence does not, as a general rule, lead to permanent residence. It is worth factoring this into long-term relocation plans.
What documents are needed?
The exact set depends on the ground, but the core is always the same: proof of the family relationship and the relative’s consent. In general terms, the file includes:
- passports of the applicant and of the relative the ground is based on;
- proof of relationship — marriage and birth certificates; those issued abroad are submitted with a notarised translation (documents from CIS countries and Türkiye follow the procedure set by international agreements);
- the consent of the relative or family member — notarised, or confirmed by them in person at submission;
- for dependent parents — documents confirming dependency;
- standard documents: a medical certificate, photographs and proof of address.
— SME: Plan your family members’ permits together with the main applicant’s permit — it makes it easier to align permit terms and renewals. Prepare marriage and birth certificates issued abroad well in advance: translation and certification often take longer than expected.
Frequently asked questions
Can the spouse of an Azerbaijani citizen get a residence permit?
Yes. A spouse is among the citizen’s close relatives — this is a ground for a temporary permit and, after at least 2 years of continuous temporary residence, for a permanent one.
Can I get a residence permit for my parents?
Parents of an Azerbaijani citizen — yes, as close relatives. Parents of a foreign permit holder — if they are dependent on that person.
Can adult children get a residence permit?
Children of a foreign permit holder qualify up to age 18, and over 18 if they are unable to work. Children of an Azerbaijani citizen are close relatives with no age limit.
How long is a family residence permit valid?
A temporary permit is issued for up to 1 year and extended each time for up to 2 years. A permanent permit is issued for 5 years and can be extended.
