Azerbaijan Work Permit: Who Applies, Validity and Exemptions (2026)

A foreign national can legally take up employment in Azerbaijan once a work permit has been issued. The process is clear, increasingly digital, and several categories of foreigners do not need a work permit at all.

Short answer: In Azerbaijan, the work permit is obtained by the employer — a company, an individual entrepreneur or a branch of a foreign company — from the State Migration Service. It is issued for 1 year (or for the term of the employment contract if shorter) and can be extended each time for up to 1 year. Permanent residents, entrepreneurs and heads of foreign company branches, among others, are exempt.

Who applies for the work permit — the employee or the employer?

The employer applies. According to the State Migration Service, a foreign national aged 18 or over may work in Azerbaijan after the work permit has been obtained by the hiring party: a legal entity, an individual running a business without forming a legal entity, or a branch or representative office of a foreign company.

An employment contract with a foreign national cannot be signed before the work permit is issued. The review takes into account whether there is a vacancy and whether the employment service can meet the employer’s need from the local labour force — which is why the application includes a justification for the hire. Since 1 November 2024, work permits are issued electronically: once the state fee is paid, the employer receives the permit in electronic form.

How long is the work permit valid and how is it extended?

Item Rule
Applicant The employer
Initial term 1 year, or the term of the employment contract if under a year
Extension Each time for up to 1 year; up to 2 years for work in the liberated territories
When to apply for extension At least 30 days before the permit expires
Review period Depends on the processing term chosen and the state fee paid under the Law on State Fee
Early termination of the contract The employer notifies the Migration Service within 5 working days

Who does not need a work permit?

The Migration Code sets out a list of cases where no work permit is required. The main ones include:

  • holders of a permanent residence permit;
  • persons engaged in entrepreneurial activity in Azerbaijan;
  • heads of branches and representative offices of foreign legal entities and their deputies;
  • heads of an Azerbaijani company whose founder is a foreign person, and a founder holding at least a 51% share;
  • spouses of Azerbaijani citizens, provided the citizen spouse is registered at a place of residence in the country;
  • highly skilled migrants working in their field of expertise, technology park residents and the ICT specialists they engage;
  • staff of diplomatic missions and international organisations, accredited journalists, and persons on business trips of no more than 90 days a year.

The full list is longer, and the exact conditions matter in each case — for example, the size of a founder’s share or the employer’s status.

How are the work permit and the residence permit connected?

A work permit is one of the grounds for a temporary residence permit. They are two separate documents, but they are linked: if the employment contract ends early, the work permit loses its validity. If the employee has no other ground to stay, they must leave the country within 10 working days. That is why a change of employer is best planned in advance — the new permit is obtained by the new employer.

— SME: In practice, the difficulties are more often about deadlines than refusals. A work permit extension must be filed at least 30 days ahead, and the employee’s residence permit relies on that work permit. We keep a deadline calendar for every foreign employee so that both documents are renewed without gaps.

Frequently asked questions

Can a foreign national obtain a work permit on their own?
No, the employer is the applicant. If the foreign national runs their own business in Azerbaijan, they do not need a work permit.

How long is an Azerbaijan work permit valid?
1 year, or the term of the employment contract if it is shorter than a year. It can then be extended each time for up to 1 year.

Do permanent residents need a work permit?
No. Foreign nationals holding a permanent residence permit can work without a work permit.

What happens if the employee leaves before the permit expires?
The employer informs the Migration Service within 5 working days and the permit loses its validity. Without another ground to stay, the employee must leave the country within 10 working days.
